There are several ongoing mass tort cases litigating illnesses derived from consumer hair straightener products. Women nationwide have filed lawsuits alleging they have suffered serious illnesses such as uterine cancer, breast cancer, ovarian cancer, endometriosis, and uterine fibroids. Initial cases implicate brands such as DAX, L’Oreal, Revlon, and Organic Root Stimulator, with additional products likely to be considered going forward.
These cases involve individuals who claim to have suffered serious health problems such as hair loss, severe discolorations, and scalp burns as a result of using these products. Many of these cases are being brought against major manufacturers of hair straighteners, alleging that these companies failed to adequately warn consumers of the risks associated with their products. As the litigation continues, it is likely that more individuals will come forward with similar claims, and the companies involved may face significant financial liability.
The first hair straightener lawsuits were filed in October 2022 in California and Illinois by women who developed cancer after regular use of chemical hair straighteners and relaxers. The plaintiffs in these cases claim the manufacturers knowingly sold dangerous products with improper warnings to customers, putting their profits over consumer safety. And after a landmark study revealed greater cancer risk among people regularly exposed to this class of products, many more lawsuits ensued.
With thousands of individual hair straightener and relaxer product liability cases filed across the country, a United States Judicial Panel consolidated them into a multi-district litigation, or MDL, in the U.S. District Court for the Northern District of Illinois. An MDL provides a more efficient process for litigating such a large number of related lawsuits, as a single federal judge manages all the cases and the parties share in the lengthy discovery process. A few test or “bellwether” cases will go to trial in November 2025, and the outcome will help determine whether the remaining cases will settle and for how much.
